2. What personal data do we process?

When you use our Services, we process personal data about your connection with our cookies, i.e. information that is automatically recorded by our servers when you access or use the website, whether or not you are registered on the website or connected to your user account.

3. For which purposes we process your personal data and under which legal basis?

We process and store your personal data for the following purposes:

  • Your personal data may also be communicated to the police (if required by law) or to any person legally authorized to receive this information (by order of the judge).

5. How your data are hosted?

We endeavour to secure the personal data of the users appropriately and have taken all useful precautions in order to preserve and ensure that our hosting subcontractors preserve the security and the confidentiality of this data, and in particular prevent it from being distorted, damaged or disclosed to unauthorized persons.

Please kindly note that our newsletter provider which may have access to your personal data if you opted in to the newsletter is located outside of Europe in USA but is certified with EU-US Privacy Shield. As such, this provider shall be deemed to provide adequate privacy protection for the transfer of personal data originating from the EU by virtue of such self-certification.

6. How long do we keep your personal data?

Once you terminate your user account, we will retain your personal data for a limited period of time to answer to our legal obligations and exercise our legal rights but in no event more than five (5) years from the end of the service. After this, your personal data will be deleted.

Your personal data will also be destroyed if you do not access your user account for over five (5) years.

All the personal data we collect for the purposes of providing you more accurate services based on collected user connection data will however be deleted within a maximum period of 13 months from the initial placement of the cookie.

7. Your rights

We will respect your legal rights associated with the processing of your personal data. Below are the rights that you have under applicable laws, and what PACDIV does to protect those rights. Please note that for the sake of security, we may ask you to verify your identity before processing your request:

  • Request access to your personal data. This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it;

  • Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected;

  • Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have exercised your right to object to processing (see below);

  • Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and the circumstances of your particular situation mean you wish to object to processing on this ground;

  • Request the restriction of processing of your personal data. This enables you to ask us to suspend the processing of personal data about you, for example if you want us to establish its accuracy or the reason for processing it;

  • Request the right to obtain a copy of your personal data in a structured, commonly used and machine-readable format or to transfer the personal data to another data controller when it is technically possible to do so;

  • Provide instructions regarding the processing of your personal data after your death.

We will respond and reply to your above requests as soon as possible, and generally within seven days and no later than one month upon receipt of your request (If necessary and as permitted by law, we may extend it by an additional two months. We will inform you the reason for the extension within the aforementioned one month, for example, if the request is complex or involves a large volume of data).

If your request or concern is not satisfactorily resolved by us, you may also contact your local data protection supervisory authority and lodge a complaint.
